Warranties:

The CRA/SMA is a "Cloud" based service and requires the need for a third-party service provider. It understood that the service provider we use, and/or its’ assigns do not guarantee, imply, or predict any type of profit or response from said services. The client irrevocably covenants, promises and agrees to indemnify the service provider and/or its’ assigns and to hold the service provider and/or its’ assigns harmless from and against any and all losses, claims, expenses, suits, damages, costs, demands or liabilities, joint or several, of whatever kind or nature which the service provider and/or its’ assigns may sustain or to which the service provider and/or its’ assigns may become subject arising out of unlawful access or relating in any way to the use of the services provided under this Agreement, including, without limitation, in each case attorneys’ fees, costs and expenses actually incurred in defending against or enforcing any such losses, claims, expenses, suits, damages or liabilities. You agree to use the Service at your own risk.

 

WE MAKE NO WARRANTIES TO THE CLIENT OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO THE SERVICE DESALLEN PTY LTD, ITS SUBCONTRACTORS AND AFFILIATES PROVIDE YOU. WE EXPRESSLY DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS OF THIS SERVICE FOR A PARTICULAR PURPOSE.

We shall not be liable for any damages suffered by the client, whether indirect, special, incidental, exemplary, or consequential, including, but not limited to, unlawful and/or unauthorized access, loss of data or service interruptions, regardless of cause or fault. We are not responsible for lost profits or for loss of data or information.

While we take all reasonable precautions to ensure your database is secure and protected the client understands and agrees that the service provider is under no obligation to export, extract, retrieve or reconfigure in part or whole, the client’s database except through our own IMPORT/EXPORT functions.

Software Errors:

Des Allen Pty Ltd. agrees to correct and rectify any software ‘Bugs’ (meaning any miscalculations) or errors in the display of information or data, that are reported – Free of Charge.

Modifications:

Any Modifications may be considered on the basis that they add value and enhance the system for all users otherwise they are  to the system and enUnique client modifications that enhance thThis does not include

 Q. What information do we collect?

As a Registered Client and user of the Culture Risk Analysis, you may be required to at some time, enter some of the following general information: Company Name, e-mail address, Delivery or Postal Address, a Contact Name, Tel. No. and Country.

As part of the systems internal processes base information regarding Company Personnel is required – This information is made available to Clients Only.

Q. What do we use your information for?

Any of the information we collect from you may be used in one of the following ways:

- To allow system access to and from Company Personnel.

- Where applicable, to process transactions through to a registered payment gateway

Any employee information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason, without client consent, other than for the express purpose of delivering the licenced product or service.

Q. How do we protect any sensitive payment information?

We utilise the use of a secure server. Where applicable, All/Any supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and whom are required to keep the information confidential.

After a transaction, any such private information (credit card details etc.) are not and will not be stored on our servers.

A. We do not use cookies.

Q. Do we disclose any information to outside parties?

A. We do not sell, trade, or otherwise transfer to outside parties any personally identifiable information. This does not include trusted third parties who assist us in operating our website(s), conducting our business to service clients, so long as those parties agree to keep this information confidential. We may release information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety.

However, non-personally identifiable information may be provided to other parties for marketing and statistical analysis, advertising, or other uses upon approval from the client.

Refunds:

The Annual licence fee is non-refundable
